PET SALES CONTRACT
Parties to this agreement are
(Buyer)___________________________________and
_____________________________(Breeder) . They are referred to herein
after as Buyer and Breeder. The Buyer understands the following terms
and conditions of this contract are in order to obtain said dog from
Breeder. If the Buyer should default in any manner on any of the terms
or conditions herein, the breeder has the right to reclaim said dog
from the buyer, with the AKC registration papers signed over in full to
the breeder, with no compensation, monetary or otherwise, given to the
buyer.
1. It is understood that this dog is NOT considered to be of show or
breeding quality, but is a representative of it's breed and
structurally and temperamentally suited as a companion or buyer has
chosen to not show this show quality dog. This dog will be on a LIMITED
AKC registration. The Buyer agrees that this dog will not be bred and
further that said dog will be neutered /spayed before seven months of
age. Proof of neutering, signed by performing veterinarian will be
forwarded to the Breeder by ____________. Buyer understands and agrees
that if spay/neuter provision is not complied with, a breach of
contract has occurred. A fee of $1500 will apply for non-compliance of
alteration agreement. If any puppies are produced from this dog Buyer
understands that it will cause irreparable damage to the reputation of
the Breeder. Therefore, it is agreed that in such event, Buyer shall
pay to the Breeder, as liquidated damages and not as a penalty, the sum
of $1500 per puppy produced in violation of this condition.
2. This dog is guaranteed to be in good health at the time of sale. It
is recommended that this dog be examined by the Buyers veterinarian, at
Buyers expense, within 48 hours. Should any serious illness be found at
that time (except those due to injury or neglect after the sale), upon
written notification from the veterinarian, this dog may be returned
for a refund of the purchase price (the amount of cash actually paid by
the Buyer to the Breeder). If the Buyer chooses to keep the dog, the
Buyer assumes all responsibility and the Breeder is no longer liable.
3. The Buyer will be given a complete record of all inoculations and
wormings done prior to the sale. Buyer will be provided with at least a
four generation pedigree.
AKC registration papers will be supplied at the time of sale or
forwarded upon receipt from AKC.
4. The Buyer agrees to maintain said dog in good health. It is
recommended that the Buyer follow the written feeding and maintenance
instructions given at the time of sale.
5. Buyer will be solely responsible for any claims arising from said
dog's actions.
6. This dog is considered to be a family companion and thus, a house
dog which will not be left out in the weather. The Buyer agrees to
provide this dog with a fenced yard and/or will not permit this dog to
run loose outside its owner's yard. The Buyer agrees that this dog will
not be chained, used as a guard dog or attack trained. The Buyer shall
never abandon this dog to an animal shelter or sell it to a research
center. NO PROGENY OF THIS DOG SHALL BE SOLD, GIVEN OR TRANSFERRED IN
ANY MANNER TO A PET SHOP, LITTER LOT, OR PERSONS CONTEMPLATING BREEDING
FOR SALE TO COMMERCIAL DISTRIBUTORS OF DOGS OR GUARD DOG BUSINESSES.
Buyer understands that violation of these terms will cause physical and
emotional harm to this dog and/or the puppies and irreparable damage to
the reputation of the Breeder. Therefore, it is agreed that in such
event, Buyer will pay to the Breeder, as liquidated damages and not as
a penalty, the sum of $1500 per dog or puppy placed in violation of
these conditions.
7. Buyer agrees that if for ANY reason they can not keep said dog, that
they will release dog back to the Breeder, with AKC registration papers
signed over, with no monetary reimbursement at that time. When said dog
is placed in a new home any money received from new owners, minus what
ever expenses Breeder has incurred to board and care for the dog, will
be forwarded to the Buyer.
8. Dog may not, at any time, be transferred to another person other
than the Breeder without written consent from the breeder.
ENTIRE AGREEMENT- It is understood and agreed that Buyer by signing
this form has read and understands the provisions of this contract.
Furthermore, this written agreement constitutes all conditions of the
sale and no verbal statements either before or after the sale will be
binding in any way.
A non refundable deposit of $____ reserves said dog for Buyer until
__________ at which time Buyer will pay the balance of the purchase
price of $_____ in cash and take delivery of the dog, or Buyer's
deposit will be forfeited and Breeder shall be free to sell the dog to
another buyer. The undersigned have read this agreement, understood it,
and agree to perform its terms on the day and date written below. This
agreement shall not be in effect until both signatures are affixed and
deposit has been accepted.
